Today I’m talking about metaverse law, specifically avatar copyright issues.

My conclusion upfront: the definition of “commercial use” in VN3 License is way too unclear. I don’t think I’m the only one struggling with this.

Avatars Are the Biggest Source of Disputes in the Metaverse

The line between who made a model and how far others can use it is ambiguous, yet tens of thousands of people are buying and using avatars.

What Does “Commercial Use” Even Mean?

What I wonder every time I look at a VN3 License is that the definition of “commercial use” is vague.

In my case, I’m not active as a VTuber. Full Body Tracking Lab is primarily device reviews and information sharing. It’s basically a money-losing operation.

So it’s not commercial use, right? That’s what I think.

But I have affiliate links on my site for convenience — so friends can find where to buy things. If someone says “that’s commercial use,” that’s the end of the discussion.

Is having affiliate links alone “commercial”? Is near-zero revenue “commercial”? Is operating at a loss “commercial”?

This line isn’t clear in current VN3 Licenses.

My Conclusion: Choose Avatars with Free Commercial Use

My conclusion is simple: choose avatars where commercial use is explicitly free.

Rather than agonizing over gray zones, just use avatars that clearly state “commercial OK.” That’s best for peace of mind.

Avatar selection isn’t just about cuteness or specs — license generosity is also an important criterion.

A Request to Creators

Please be more specific about what “commercial use” means:

  • Is a site with affiliate links commercial?
  • Is a personal blog with near-zero revenue commercial?
  • Is streaming with Super Chat donations commercial?
  • Is a sponsored content creator commercial?

Just clarifying these four points would let users judge for themselves.

A Proposal for VN3 License

I suggest adding tiers to the “commercial use” category:

  • Individual monetization (affiliates, donations): OK / NG
  • Individual product sales (merchandise, doujinshi): OK / NG / ASK
  • Corporate sponsorship: OK / NG / ASK
  • Corporate business use: OK / NG / ASK

The current “commercial use: OK / NG / ASK” alone is too broad for anyone to judge.
